1. Introduction

Welcome to Postology, a platform operated by Aurum Avis Labs GmbH (“Company,” “we,” or “us”). By accessing or using Postology (“the Platform”), you agree to comply with and be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

These Terms & Conditions are governed by Swiss law, specifically the Swiss Code of Obligations (CO). They apply to all users worldwide unless otherwise explicitly stated.

2. Services Overview

Postology is an AI-powered platform designed to assist creators, influencers, and businesses in managing and monetizing their social media presence. Key features include:

• Account Creation Agent

• Post Scheduling and Editing

• Postqueue Management

• Dashboard for Analytics and Monitoring

• Subject Link Integration

• Advanced AI Tools (Reels, Post Styling, and Voiceovers)

The Platform also provides a subscription-based model, offering various service tiers tailored to individual or business needs.

3. User Obligations

Users agree to use the Platform in compliance with the following rules:

• Explicit Content: Users may not create or publish content that is illegal, defamatory, hateful, obscene, or sexually explicit.

• Intellectual Property: Users may not upload or share content that infringes on the intellectual property rights of others.

• Age Requirement: Users must be at least 18 years old to register and use the Platform.

• Ethical Conduct: Users agree not to exploit, manipulate, or misuse any features of the Platform for fraudulent activities or spam.

Violations of these obligations may result in the immediate suspension or termination of accounts.

4. Payment Terms

• Payment processing is handled securely through Stripe.

• Users subscribe to a monthly plan, which may be canceled at any time. Subscription fees for the current month are non-refundable.

• Failure to process payment may result in account suspension until the issue is resolved.

5. Refund Policy

All purchases are final, and no refunds will be issued. This policy is in accordance with Article 62 of the Swiss Code of Obligations, which allows parties to set clear refund terms in contracts.

6. Liability and Disclaimers

• The Company provides tools and recommendations through AI; however, the user remains fully responsible for the content they create and publish using the Platform.

• The Company is not liable for damages, including but not limited to loss of profits, data breaches, or reputational harm, resulting from user-generated content.

• While Postology strives for uninterrupted service, it does not guarantee that the Platform will always operate without errors or interruptions.

This limitation of liability aligns with Articles 100–101 of the Swiss Code of Obligations.

7. Jurisdiction

These Terms & Conditions are governed by the laws of Switzerland. Any disputes arising from these Terms shall be resolved in the courts of Zurich, Switzerland.

8. Special Provisions

In addition to the above:

• Users agree not to upload content or use features that breach Swiss copyright law (Swiss Federal Copyright Act).

• Data shared or stored on the Platform complies with the Swiss Federal Act on Data Protection (FADP) and GDPR when applicable for EU users.

• Users acknowledge and consent to data transfers outside Switzerland when necessary for global services.

9. Modifications

The Company reserves the right to modify these Terms & Conditions at any time. Changes will be notified via the Platform or email, and continued use of the Platform signifies acceptance of the updated Terms.
